(“Achromic Labs”, ”BuildMyResume.co”, “we,” “us,” or “our”). By using BuildMyResume.co (the “Service”) or clicking “I Agree,” you accept these Terms and agree to follow them. If you don’t agree, please don’t use the Service.
We may update these Terms at any time. We’ll do our best to give you a heads-up about major changes. If you keep using the Service after changes are made, it means you accept them. 1. Service
a. BuildMyResume.co “Service” refers to the online resume building tools and resources provided by Achromic Labs Inc. through the website BuildMyResume.co. This includes any downloadable software, mobile or desktop applications, and all related intellectual property. Anyone accessing or using the BuildMyResume.co Service, whether for personal or professional reasons, is a “BuildMyResume.co User.”
b. Achromic Labs Inc. grants you a non-exclusive, revocable, non-transferable license to use the BuildMyResume.co Service for your personal resume creation needs. You may not resell or redistribute the Service without explicit written permission from Achromic Labs Inc.
c. Achromic Labs Inc. reserves the right to modify, relocate, update, or discontinue the BuildMyResume.co Service, or any portion of it, at any time and without prior notice. We may also restrict or terminate your access to the Service at our discretion.
2. Access
a. You are responsible for providing your own computer, mobile device, and internet connection to access the BuildMyResume.co Service. Achromic Labs Inc. is not responsible for any performance issues related to your equipment or internet connectivity.
b. You are solely responsible for all costs associated with your equipment, internet service, and any cellular data usage related to accessing the BuildMyResume.co Service.
3. Deactivation and Termination
a. Achromic Labs Inc. may restrict, deactivate, or terminate your access to the BuildMyResume.co Service, or any part of it, at any time and without notice. We may also terminate or modify the Service itself without prior notice.
b. Achromic Labs Inc. will not be liable to you or any third party for any termination or modification of the BuildMyResume.co Service. If you are dissatisfied with any changes, your only remedy is to stop using the Service.
4. Privacy Policy
a. Achromic Labs Inc.’s Privacy Policy outlines how we collect, use, and protect your personal information. By using the BuildMyResume.co Service, you consent to the terms of our Privacy Policy.
5. Third parties contractors

8. Confidentiality
Any non-public information that Achromic Labs Inc. shares with you regarding the BuildMyResume.co Service is confidential and should not be disclosed to third parties without our written consent.
9. BuildMyResume.co Communications
By using the BuildMyResume.co Service, you consent to receive electronic communications from Achromic Labs Inc. regarding your account, security, and other service-related issues.
10. Content Submitted to BuildMyResume.co
a. Your Content: By submitting any information, opinions, creative suggestions, ideas, or other materials (“Content”) to the BuildMyResume.co Service, you grant Achromic Labs Inc. a worldwide, non-exclusive, royalty-free, perpetual, and irrevocable right to use, reproduce, distribute, modify, and publicly display that Content. This includes the right to use your Content to improve and promote the BuildMyResume.co Service, but we will not use your name in our marketing materials without your prior consent.
b. No Confidentiality: Your Content will not be treated as confidential, and Achromic Labs Inc. will not be liable for any use or disclosure of your Content.
c. Content Removal: Achromic Labs Inc. may remove or modify any Content at any time for any reason.
d. User Responsibility: You are solely responsible for the Content you submit to the BuildMyResume.co Service. You represent and warrant that your Content does not infringe on any third-party rights, including copyrights, trademarks, or privacy rights, and that it does not contain any harmful code or confidential information.
e. Messaging: The BuildMyResume.co Service may allow users to exchange messages. This is a privilege that can be revoked at any time. You are responsible for the content of your messages, and Achromic Labs Inc. may monitor messages for compliance with these Terms & Conditions.
f. Monitoring and Removal: Achromic Labs Inc. reserves the right to monitor the BuildMyResume.co Service and remove any Content that violates these Terms & Conditions or is otherwise objectionable.

11. Third-Party Services
a. Achromic Labs Inc. may integrate with third-party services or offer third-party products (e.g., plugins, apps) (“Third-Party Services”) through the BuildMyResume.co Service. Your use of any Third-Party Service is solely between you and the third-party provider.
b. Achromic Labs Inc. does not endorse, warrant, or provide support for any Third-Party Services. We are not responsible for their availability, functionality, or compliance with any laws.
c. Achromic Labs Inc. may discontinue any Third-Party Service integration at any time, without any obligation to provide refunds or compensation.
12. Ownership and Intellectual Property
a. BuildMyResume.co Service: The BuildMyResume.co Service, including all content, templates, and software, and all related intellectual property rights (“BuildMyResume.co IP”) are owned by Achromic Labs Inc. and its licensors. You are granted a limited license to use the BuildMyResume.co Service, but no ownership rights are transferred to you.
b. Trademarks: “BuildMyResume.co” and other related marks are trademarks of Achromic Labs Inc. You may not use these trademarks without our written permission.
c. Feedback: Any feedback, comments, or suggestions you provide to Achromic Labs Inc. about the BuildMyResume.co Service are considered non-confidential and become the property of Achromic Labs Inc.
d. Usage Data: Achromic Labs Inc. may collect and analyze anonymized data about your use of the BuildMyResume.co Service (“Usage Data”) to improve the Service and develop new features.
13. Claims of Copyright Infringement
a. If you believe any content on the BuildMyResume.co Service infringes your copyright, please notify us at support@buildmyresume.co with the following information:
* A physical or electronic signature of the copyright owner or their authorized agent.
* Identification of the copyrighted work that is allegedly infringed.
* Identification of the infringing material on the BuildMyResume.co Service.
* Your contact information.
* A statement that you have a good faith belief that the use of the material is not authorized.
* A statement, made under penalty of perjury, that the information in your notice is accurate.
b. If you believe a copyright infringement notice has been wrongly filed against you, you may submit a counter-notice to support@buildmyresume.co.
14. Payment Terms, Order Processing and Refund Policy
a. Fees: Access to certain features or functionalities of the BuildMyResume.co Service may require payment of fees. These fees may be one-time or recurring subscription charges. You will have the opportunity to review all applicable fees before making any payment.
b. Recurring Subscriptions: By activating a recurring subscription, you authorize Achromic Labs Inc. or its payment processor to automatically charge you the subscription fee at regular intervals until you cancel. You can cancel your subscription at least 24 hours before the end of the current billing cycle to avoid being charged for the next cycle.
c. Free Trial: Achromic Labs Inc. may offer a free trial period for certain features or services. You can cancel your free trial at any time through your account settings.
d. Payment Processing: Achromic Labs Inc. uses third-party payment processors, such as Stripe Inc., to process payments for the BuildMyResume.co Service. By providing your payment information, you agree to our sharing of this information with the payment processor and consent to be bound by their terms and conditions and privacy policy.
e. Stripe Services Agreement: If Stripe Inc. is used as the payment processor, your payments will be subject to the Stripe Connected Account Agreement, which includes the Stripe Terms of Service. You agree to be bound by these agreements.
f. Exceptional Circumstances: In certain exceptional circumstances, Achromic Labs Inc. may, at its sole discretion, consider issuing a partial or full refund. These circumstances may include, but are not limited to, significant technical issues with the Service that prevent you from using it as intended, or errors in billing.
g. Refund Requests: To request a refund, please contact our support team at support@buildmyresume.co. All refund requests will be reviewed on a case-by-case basis.
h. No Guarantee of Approval: Submitting a refund request does not guarantee that a refund will be issued. Achromic Labs Inc. reserves the right to deny any refund request that does not meet the criteria for exceptional circumstances.
15. Prohibited Conduct
- Excessive Use: You agree not to make excessive or unreasonable requests to our API that may overload, damage, or impair our systems, or interfere with other users’ access to our services. We reserve the right to determine what constitutes “excessive” or “unreasonable” use.
- Denial-of-Service Attacks: You are strictly prohibited from engaging in any activity that disrupts or interferes with the availability, reliability, or security of our API, including but not limited to denial-of-service (DoS) attacks, distributed denial-of-service (DDoS) attacks, or any other attempts to disrupt or overload our systems.
- Automated Access: You agree not to use any automated means, such as bots, scrapers, or crawlers, to access or interact with our API without our express written permission.
- Rate Limiting: We may implement rate limits on API requests to prevent abuse and ensure fair usage for all users. You agree to comply with any such rate limits and not attempt to circumvent them.
- Monitoring and Enforcement: We reserve the right to monitor API usage for abusive behavior and take appropriate action, including but not limited to suspending or terminating your access to the API, if we detect any violations of these terms.
16. Consequences of Abuse
- Account Suspension: We may suspend your account or access to the API, with or without notice, if we believe you are violating these terms or engaging in any abusive behavior.
- Account Termination: We may terminate your account and permanently ban you from using our services if we determine that you have engaged in severe or repeated violations of these terms.
- Legal Action: We reserve the right to take legal action against you if your actions cause harm to our systems, our users, or our business.
17. Term and Termination
a. Term: These Terms & Conditions are effective from the date you first access or use the BuildMyResume.co Service and remain in effect until terminated by either you or Achromic Labs Inc.
b. Termination: Either party may terminate these Terms & Conditions with written notice if the other party materially breaches these terms and fails to cure the breach within 30 days. Achromic Labs Inc. may also terminate your access to the BuildMyResume.co Service for any violation of these Terms & Conditions.
c. Effect of Termination: Certain sections of these Terms & Conditions will survive termination, including those related to ownership, disclaimers, limitations of liability, and governing law. Termination does not relieve either party of liability for obligations incurred before termination.
18. Disclaimer of Warranty
a. No Warranties: Achromic Labs Inc. provides the BuildMyResume.co Service “as is” and makes no warranties, express or implied, regarding the Service or any third-party services. This includes disclaiming any warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability.
b. No Guarantee of Satisfaction: Achromic Labs Inc. does not guarantee that the BuildMyResume.co Service will meet your requirements or be error-free. We also do not guarantee uninterrupted operation of the Service.
c. Assumption of Risk: You acknowledge that your use of the BuildMyResume.co Service is at your own risk. Achromic Labs Inc. is not responsible for any loss, damage, or liability arising from your use of the Service, including any reliance on information provided through the Service.
d. Third-Party Information: Achromic Labs Inc. is not responsible for any information, statements, or representations made by other users of the BuildMyResume.co Service. You acknowledge that any reliance on such information is at your own risk.
e. Limitations on Exclusions: In some jurisdictions, limitations or exclusions of warranties may not be permitted. In such cases, the above limitations may not apply to you to the extent prohibited by law.
19. Indemnification
a. Defense: If Achromic Labs Inc. requests it, you agree to defend us, our affiliates, and our respective directors, officers, employees, and agents (“Achromic Labs Parties”) against any claims, lawsuits, or proceedings arising from: (1) your breach of these Terms & Conditions; (2) your unauthorized use of the BuildMyResume.co Service; or (3) claims made against Achromic Labs Inc. by others you allow to access the Service.
b. Achromic Labs Inc. Cooperation: If we request you to defend us, we will provide you with timely notice of the claim, give you control over the defense and settlement of the claim, assist you as reasonably requested, and comply with any settlement or court order. However, you may not settle any claim that admits our guilt or liability without our prior written consent. We may also choose to participate in the defense at our own expense.
c. Indemnification Obligations: You agree to indemnify and hold harmless the Achromic Labs Parties from any damages, costs, attorney’s fees, and expenses finally awarded against us in connection with such claims, lawsuits, or proceedings, as well as any out-of-pocket costs and settlement amounts reasonably incurred in defending against such claims.
20. Limitation of Liability
a. Exclusion of Damages: Achromic Labs Inc. and the Achromic Labs Parties will not be liable for any indirect, consequential, incidental, special, or punitive damages arising out of or related to these Terms & Conditions or your use of the BuildMyResume.co Service. This includes any lost profits, loss of business, or loss of data, even if we have been advised of the possibility of such damages.
b. Damages Cap: Our total liability to you for any claims arising out of or related to these Terms & Conditions or the BuildMyResume.co Service, regardless of the legal theory, will not exceed the greater of: (1) the amount of fees you paid to us in the three months preceding the claim; or (2) $100.
c. Independent Investigation: You acknowledge that you have independently evaluated the advisability of using the BuildMyResume.co Service and the potential risks involved. You agree to maintain appropriate insurance coverage for such risks and will rely solely on that insurance for reimbursement of any resulting damages.
21. Protected Activity
a. These Terms & Conditions do not restrict your right to file complaints or cooperate with government agencies.
b. You may disclose documents or information as permitted by law in connection with such protected activity.
22. Compliance with Applicable Law
a. Both you and Achromic Labs Inc. agree to comply with all applicable laws and regulations in relation to these Terms & Conditions and the BuildMyResume.co Service.
23. Miscellaneous
a. Governing Law: These Terms & Conditions are governed by the laws of Alberta, without regard to its conflict of laws principles.
b. Jurisdiction and Venue: Any legal action related to these Terms & Conditions or the BuildMyResume.co Service must be filed in the courts of Alberta. You consent to the jurisdiction of these courts. The prevailing party in any such action is entitled to recover its legal fees and costs.
c. Injunctive Relief: Achromic Labs Inc. may seek injunctive or other equitable relief for any breach of these Terms & Conditions, particularly those related to registration, eligibility, restrictions, and ownership.
d. Further Assurances: You agree to cooperate with Achromic Labs Inc. in taking any actions necessary to give full effect to these Terms & Conditions.
e. Assignment: You may not assign these Terms & Conditions without our written consent. Achromic Labs Inc. may assign these Terms & Conditions without your consent.
f. Severability: If any provision of these Terms & Conditions is found invalid or unenforceable, the remaining provisions will remain in effect.
g. No Waiver: No waiver of any provision of these Terms & Conditions will be effective unless in writing and signed by the waiving party.
h. Entire Agreement: These Terms & Conditions constitute the entire agreement between you and Achromic Labs Inc. regarding the BuildMyResume.co Service and supersede any prior agreements.
i. Intellectual Property Rights: The licenses granted under these Terms & Conditions are considered intellectual property rights under applicable bankruptcy laws.
j. Relationship of the Parties: The relationship between you and Achromic Labs Inc. is that of independent contractors. Neither party has the authority to bind the other or create any agency, partnership, or joint venture relationship.
k. No Third-Party Beneficiaries: There are no third-party beneficiaries to these Terms & Conditions, except as explicitly stated (e.g., with respect to Apple Inc. if you are using the Service on an iOS device).
l. Notices: All notices must be in writing and are considered delivered upon personal delivery, three business days after being sent by mail, or upon acknowledgment of receipt if sent by email. You can send notices to Achromic Labs Inc. at support@buildmyresume.co.
m. Force Majeure: Achromic Labs Inc. is not liable for any delays or failures to perform due to events beyond our reasonable control. If such events continue for 30 consecutive days, either party may terminate these Terms & Conditions.
n. Interpretation: The English language version of these Terms & Conditions controls. Headings and captions are for convenience only. The word “including” is used in an inclusive sense.
